01. Authorization to Sell & Represent Content
By creating a creator account and uploading audio recordings, full tracks, beats, or ringtones (the "Content") to HitMarket, you hereby grant HitMarket a worldwide, non-exclusive, revocable license and authorization to act as your digital sales representative and distributor for the Content.
- Host, encode, and store master audio files on high-security object storage infrastructure (Backblaze B2).
- Transmit secure, anti-rip preview audio streams to prospective buyers and listeners.
- Issue commercial licenses, non-exclusive beat licenses, and sample clearance certificates to buyers on your behalf.
- Process financial transactions, debit/credit cards, and patron donations via authorized payment gateways.
02. Ownership & Copyright Guarantee
HitMarket does NOT acquire ownership of your musical works. You remain the sole proprietor of the underlying musical composition, master sound recording, lyrics, sound design elements, and performance rights.
You may revoke this distribution authorization at any time by archiving or deleting your tracks from your Creator Upload Studio, without penalty.
03. Identity Verification & KYC Requirements
To prevent copyright infringement, fraudulent sample repackaging, and impersonation of artists, HitMarket requires creators who publish content for sale to complete Know-Your-Customer (KYC) identity verification:
- Submission of a government-issued National ID, International Passport, or Driver's License.
- Matching full legal name and country of residence with payout recipient documentation.
- Identity records are stored encrypted in compliance with GDPR and international data protection standards.
04. Creator Warranties & Originality
You warrant and guarantee that:
- You are the sole author, producer, and copyright holder of the Content, or hold documented, legal clearance for all utilized samples.
- The Content does not violate the intellectual property, trademark, or publicity rights of any third party.
- You will not upload AI-generated scrapings infringing on another living artist's voice or likeness without explicit authorization.
05. Patron Tipping & Direct Support Policy
HitMarket provides a direct peer-to-peer donation and tipping feature. All donations made by fans through the "Support Artist" modal are unencumbered creator gifts. HitMarket deducts only third-party banking/interchange processing fees.
